CollectORbuild respects the intellectual-property rights of others and expects our users to do the same. Listings, images, reviews, and other content are posted by independent users. If you believe content on CollectORbuild infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (“DMCA”), and we will respond as described below. We also maintain a policy of terminating, in appropriate circumstances, users who are repeat infringers.
1. Submitting a copyright infringement notice
To report allegedly infringing content, send a written notice to our designated agent that includes all of the following (as required by 17 U.S.C. § 512(c)(3)):
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material you claim is infringing and enough information for us to locate it (for example, the listing or page URL).
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
2. Designated agent
Send notices to our designated copyright agent:
DMCA Agent, CollectORbuild (CollectORbuild, LLC)
Email: support@collectorbuild.com
Mail: [FILL IN: DMCA agent mailing address]
Notices that do not substantially comply with the DMCA may not be effective. Knowingly making a material misrepresentation in a notice may expose you to liability for damages under 17 U.S.C. § 512(f).
3. What we do with a valid notice
Upon receiving a valid notice, we will remove or disable access to the identified material and, where appropriate, notify the user who posted it. That user may submit a counter-notification as described below.
4. Counter-notification
If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notification to our designated agent that includes:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for your district (or, if outside the U.S., the district where we may be found) and that you will accept service of process from the party who filed the original notice.
If we receive a valid counter-notification, we may restore the material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.
5. Repeat infringers
We will, in appropriate circumstances, suspend or terminate the accounts of users who are repeat infringers, consistent with our Terms of Service.
6. Trademarks and counterfeits
This policy covers copyright. LEGO®, BrickLink®, and other product names are trademarks of their respective owners; CollectORbuild is independent and not affiliated with or endorsed by them. Concerns about counterfeit, infringing, or unauthorized items, or about trademark misuse, can also be reported to support@collectorbuild.com, and are addressed under our Terms.
