Terms of Service

Welcome to CollectORbuild. These Terms of Service (the “Terms”) are a binding agreement between you and CollectORbuild, LLC (“CollectORbuild,” “we,” “us”), which operates the CollectORbuild website and marketplace. By creating an account, browsing, buying, or selling, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

1. What CollectORbuild is

CollectORbuild is an online marketplace that connects independent buyers and sellers of LEGO sets, parts, and minifigures, and other collectibles. We provide the catalog, listing tools, search, checkout, and dispute process. We are a venue, not the seller of the items listed by independent sellers, and, except as described in Section 6 (sales tax), we are not the merchant of record for those items. The contract of sale for an item is directly between the buyer and the seller.

2. Eligibility and your account

You must be at least 18 years old and able to form a binding contract to use CollectORbuild. You are responsible for the accuracy of your registration information, for keeping your password confidential, and for all activity under your account. Notify us promptly of any unauthorized use. You may hold one account unless we agree otherwise in writing.

3. How buying works

When you buy, you pay the seller directly through our payment processor, Stripe. Your card details go to Stripe; CollectORbuild never sees or stores your full card number. Each seller sets their own prices, shipping, handling, and any order fees, all of which are shown before you check out. Each seller ships and is responsible for their own orders. CollectORbuild does not hold your payment in escrow.

Every order is covered by buyer protection through our claims process. If an item does not arrive or is not as described, you and the seller first try to resolve it; if you cannot, a CollectORbuildadministrator reviews the evidence from both sides and decides the outcome. A refund is one possible outcome when the evidence supports it, issued by the seller, and is not an automatic payout. This process, together with your payment method’s own protections, is your remedy;CollectORbuild is not a guarantor of any transaction.

4. How selling works

To sell, you must complete seller onboarding, including payment onboarding with Stripe Connect so that buyer payments settle to you directly, minus CollectORbuild’s fees and any sales tax we are required to collect. As a seller you agree to: list items accurately and lawfully; honor your posted prices, shipping, and policies; fulfill and ship paid orders promptly; respond to buyer messages and claims in good faith; and issue refunds when a resolved claim or your own policy calls for one. You are responsible for your own tax obligations other than the marketplace sales tax we collect, for compliance with applicable law, and for not listing prohibited or infringing items.

5. Auctions

Some listings are auctions. Placing a bid is a binding commitment to buy at your bid price if you win. Auctions may use proxy (automatic) bidding and anti-sniping time extensions. When an auction ends, the highest eligible bidder is obligated to complete the purchase under these Terms.

6. Fees and sales tax

CollectORbuild charges sellers a fee on completed sales and may offer optional paid subscriptions; current fees are disclosed in the seller tools and at checkout. As a marketplace facilitator,CollectORbuild calculates, collects, and remits applicable US sales tax on taxable orders. The buyer pays the item price plus tax; the seller receives the item price; CollectORbuild remits the tax to the relevant authorities. Tax is shown separately at checkout.

7. User content and community

You may post listings, reviews, community posts, images, and messages (“User Content”). You retain your rights in your User Content and grant CollectORbuild a non-exclusive, worldwide, royalty-free license to host, display, and distribute it to operate and promote the service. You are responsible for your User Content and represent that you have the rights to post it and that it does not violate any law or third-party right.

8. Prohibited conduct

You agree not to: list counterfeit, stolen, recalled, or prohibited items; misrepresent items or prices; manipulate feedback, bids, or search; circumvent CollectORbuild to complete or fee-avoid a transaction introduced through the service; scrape, disrupt, or reverse-engineer the service; infringe intellectual property; or use the service for any unlawful, harassing, or fraudulent purpose. We may remove content, and suspend or terminate accounts, that violate these Terms.

9. Intellectual property and third-party marks

The CollectORbuild name, logo, software, and design are our property. LEGO® is a trademark of the LEGO Group, which does not sponsor, authorize, or endorse this site. BrickLink® is a trademark of its owner; CollectORbuild is not affiliated with, endorsed by, or sponsored by BrickLink. Catalog data and images are provided in part by Rebrickable. Product names and references are used for identification only. CollectORbuild is an independent marketplace.

10. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any item sold by a seller will meet your expectations. Sellers, not CollectORbuild, are responsible for the items they sell.

11. Limitation of liability

To the fullest extent permitted by law, CollectORbuild and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to your use of the service. Our total liability for any claim relating to the service will not exceed the greater of the fees you paid to CollectORbuild in the three months before the claim, or one hundred US dollars.

12. Indemnification

You agree to indemnify and hold CollectORbuild harmless from any claims, losses, and expenses, including reasonable legal fees, arising from your User Content, your transactions, or your breach of these Terms or of applicable law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. You and CollectORbuild agree to the exclusive jurisdiction and venue of the state and federal courts located in that state, except where applicable law provides otherwise.

14. Changes and termination

We may update these Terms; material changes will be posted here with a new “last updated” date, and your continued use after the change means you accept it. We may suspend or terminate the service, or your account, at any time for a violation of these Terms or as required by law. You may stop using the service at any time.
